The employer declaration (oświadczenie o powierzeniu pracy) is the most popular form of work legalisation in Poland — faster and cheaper than a full work permit. What is an employer declaration?

The employer declaration is a document registered by the employer at the District Employment Office (PUP) before hiring a worker from abroad. Once registered, the foreigner can legally start work without the need for a separate work permit.

Conditions and Limitations

  • Validity of declaration: up to 24 months from the date of issue.
  • Type of work: only for the employer indicated in the declaration — changing employer requires a new declaration.
  • Registration obligation: the declaration must be registered at the PUP BEFORE the foreigner starts work.
  • Notification obligation: the employer has 7 days to notify the PUP that the foreigner has started or has not started work.

Registration Procedure — Step by Step

  1. 1The employer completes the declaration registration application form (available at PUP or online via praca.gov.pl).
  2. 2Submission of application at the District Employment Office competent for the employer's registered office or place of residence.
  3. 3Payment of fee: PLN 100 for declaration registration.
  4. 4PUP registers the declaration — usually within 1–7 working days.
  5. 5Employer passes the registered declaration to the worker.
  6. 6If the foreigner is abroad — submits a visa D application based on the declaration.
  7. 7Worker arrives in Poland and starts work — employer notifies PUP within 7 days.
